Cleanaway Waste Management Limited (Cleanaway or the Company) (ASX: CWY) notes today’s decision of the Victorian Supreme Court regarding an alleged historical underpayment of landfill levy at Melbourne Regional Landfill for FY18.

The EPA commenced proceedings against Cleanaway seeking to recover an alleged landfill levy underpayment on materials purchased by the Company from the adjacent Boral quarry, for use in landfill operations. Cleanaway defended the proceedings on the basis that the type of product purchased from Boral is not ‘waste’ to which landfill levies should apply. The Supreme Court has today ruled in the EPA’s favour.

The alleged landfill levy underpayment amount in FY18 is $6.9 million. The EPA has also undertaken audits for FY19 and FY22 which have indicated further alleged underpayments relating to similar products of $4.7 million and $7.2 million respectively. However, these amounts are not the subject of the Supreme Court proceedings that were decided today. These amounts are before costs and interest.

Further detail regarding these proceedings is set out in Note 33 to Cleanaway’s FY25 Financial Report.

Cleanaway is reviewing the decision and has 42 days to decide whether to appeal to the decision.

This announcement has been authorised for release by the Chairman of Cleanaway.
